By accessing PeakLearn or creating an account, you agree to these Terms in full. These Terms apply to all user roles: Admin, Instructor, Teaching Assistant, and Student.
Section 01

Acceptance of Terms Updated (9-5-2026)

Age and Legal Capacity

By using the Platform, you represent and warrant that:

  • You are at least eighteen (18) years of age and have the full legal capacity to enter into a binding agreement under the laws of the Arab Republic of Egypt
  • If you are under eighteen (18) years of age, you are using the Platform under the supervision of a parent or legal guardian who has full legal capacity under Egyptian law, and such parent or legal guardian is deemed to be the actual contracting party with PeakLearn and is fully responsible for your use of the Platform.

We reserve the right to request proof of age and/or proof of parental or guardian consent at any time, and to suspend or terminate any account where we reasonably suspect that these requirements are not met.

Changes to These Terms

We may modify these Terms and any related policies at any time, at our sole discretion. Where changes are material, we will notify users by in-platform notice before the effective date of the updated Terms.

To the maximum extent permitted under applicable law, continued access to or use of the Platform after the effective date of the updated Terms constitutes your automatic acceptance of such changes, without the need for any separate express consent. If you do not agree to the updated Terms, you must stop using the Platform and may request account termination by contacting Peaklearns@gmail.com.

Section 02

Platform Description & Role of PeakLearn Updated (9-5-2026)

PeakLearn is a multi-tenant SaaS Learning Management System (LMS) hosted at peaklearn.net. It provides:

  • Course creation and delivery tools for Instructors and Teaching Assistants.
  • Enrollment, quizzes, homework, assignments, and attendance tracking for Students.
  • Secure video streaming, watermarked file sharing, and content management.
  • Payment processing, invoice generation, and enrollment tracking.
  • Administrative controls for platform operators.

Role of PeakLearn — Technology Provider Only

Important: PeakLearn acts solely as a technology and hosting provider. It is not an educational institution, publisher, or content author.

Courses, educational content, and any related materials are independently created, owned, and provided by Instructors or tenant institutions, who remain solely responsible for:

  • The accuracy, completeness, and lawfulness of their content and course descriptions;
  • Any educational, professional, or certification claims made in relation to their courses;
  • Obtaining and maintaining all necessary intellectual property rights and permissions for the content they upload.

PeakLearn is not a party to the educational relationship between Instructors (or tenant institutions) and Students, except in relation to providing the Platform and payment processing functionalities. To the maximum extent permitted by law, PeakLearn shall not be liable for any claims arising out of or relating to the substance or quality of course content, teaching methods, or learning outcomes.

Multi-Tenant Architecture

Each subdomain operates as an isolated tenant with its own data environment. Your data — courses, grades, submissions, and personal details — is not accessible to other tenants. This isolation is enforced at the database level.

Availability

We strive for continuous availability but do not guarantee uninterrupted service. Scheduled maintenance or Force Majeure events may occasionally affect access. We will provide advance notice of planned downtime where reasonably possible. See Section 12 for our Force Majeure policy.

Account Security

You are solely responsible for maintaining the confidentiality of your credentials. Notify us immediately at Peaklearns@gmail.com if you suspect unauthorized access.

Device Session Limits

Student accounts are subject to device session limits set by the administrator. Circumventing limits using multiple devices or VPNs is a violation of these Terms and may result in account suspension.

Account Accuracy

You must provide accurate, current, and complete information at registration and keep your profile up to date. Providing false information — including false date of birth or misrepresentation of legal capacity — may result in immediate termination without refund.

Section 04

Course Enrollment

  • Eligibility: You must hold an active Student account in good standing.
  • Methods: Direct payment, free access, or admin-granted access.
  • Status: Enrolled (active) or Suspended.
  • Non-transferability: Enrollment is personal and may not be shared or transferred to another individual.
  • Content changes: Instructors may update course content at any time; such changes do not automatically entitle you to a refund.

Attendance

Attendance for live sessions is tracked within the platform. Policies are set per course by the Instructor. Missing attendance requirements does not automatically entitle you to a refund.

Section 05

Payments & Billing

Powered by Paymob PCI-DSS Compliant

All transactions are processed securely through Paymob, a licensed payment gateway regulated in Egypt and the MENA region. PeakLearn does not store your full card details. By completing a purchase, you also agree to Paymob's Terms of Service.

Accepted Payment Methods

  • Credit and debit cards — Visa, Mastercard, American Express

Pricing & Currency

Prices are displayed in Egyptian Pounds (EGP). PeakLearn may adjust prices at any time; changes do not affect already-completed purchases.

Payment Processing

Upon successful payment: enrollment is confirmed immediately, an invoice is generated in your dashboard, and a confirmation may be sent to your registered email. Failed payments will not activate enrollment.

Security

  • All payment data in transit is encrypted via SSL/TLS.
  • Card data is tokenized by Paymob and never stored in on our servers.
  • Transactions use 3D Secure (3DS) authentication where supported.
  • PeakLearn does not have access to your card number or CVV.

Chargebacks & Disputes

Contact Peaklearns@gmail.com before initiating a chargeback. We resolve legitimate disputes promptly. Fraudulent chargebacks for services already rendered may result in account suspension and potential legal action.

Section 06

Refund Policy Updated (9-5-2026)

Note: Accessing a significant portion of course content after purchase will ordinarily disqualify a refund request under our internal policy.

Eligible for a Refund

  • Request submitted within 7 days of purchase and less than 20% of content accessed.
  • Course materially misrepresented compared to its published description.
  • Technical failure by PeakLearn unresolved within 5 business days of a support request.
  • Duplicate payment made for the same course.

Not Eligible for a Refund

  • Requests submitted more than 7 days after purchase.
  • More than 20% of course content accessed.
  • Courses marked "Non-Refundable" at the time of purchase.
  • Free or complimentary enrollments.
  • Enrollment suspended due to conduct violations.
  • Change of mind after accessing content.

How to Request

Email Peaklearns@gmail.com with your student ID, invoice number, and reason. We respond within 5 business days. Approved refunds are processed through Paymob and may take 7–14 business days to reflect in your account.

Statutory Consumer Rights

Egyptian Consumer Protection Law: Nothing in this Refund Policy shall restrict or reduce any mandatory rights granted to consumers under applicable Egyptian law, including Consumer Protection Law No. 181 of 2018 and its Executive Regulations. To the extent that any provision of our internal refund policy conflicts with or provides narrower rights than those afforded by applicable mandatory law, the mandatory legal rights shall prevail. If you believe you have a statutory right to a refund beyond the scope of this policy, please contact us at Peaklearns@gmail.com and we will assess your request accordingly.
Section 07

Content & Intellectual Property Updated (9-5-2026)

Instructor Content Ownership

Instructors retain full copyright over their original materials. By uploading content to the Platform, Instructors grant PeakLearn a non-exclusive, royalty-free, worldwide license to host, deliver, and technically reproduce such content solely for the purpose of providing the Platform service to enrolled Students. Instructors warrant that their content does not infringe any third-party intellectual property rights, and remain solely responsible for any claims arising from their content.

PeakLearn's Role in Content

PeakLearn does not review, curate, or endorse Instructor content. The accuracy, legality, and completeness of all course materials, descriptions, and assessments are the sole responsibility of the uploading Instructor or tenant institution. PeakLearn is not liable for any educational, professional, or certification representations made by Instructors.

Video Content

Course videos are streamed via a secure delivery system. Downloading, screen-recording, or otherwise capturing video by any technical means is prohibited. We use digital watermarking and access controls to detect and investigate unauthorized copying.

Shared Files

Files shared by Instructors may carry visible or digital watermarks. Redistribution of any shared materials outside the Platform is prohibited and may constitute copyright infringement under Egyptian and international law.

Assessments

Quizzes, homework, and assignments are for your individual use only. Sharing assessment questions or answers constitutes academic dishonesty and a violation of these Terms.

Platform IP

The PeakLearn platform — its software, design, and interface — is the exclusive property of PeakLearn and its licensors. You receive a limited, non-exclusive, non-transferable, revocable license to use the Platform for personal educational purposes only. No rights are granted beyond what is explicitly stated herein.

Section 08

Acceptable Use

You agree not to use the Platform to:

  • Violate any applicable law or regulation.
  • Transmit harmful, defamatory, hateful, or discriminatory content.
  • Harass, bully, or threaten other users, Instructors, or staff.
  • Attempt unauthorized access to any part of the Platform or its systems.
  • Scrape or systematically extract data without written permission.
  • Circumvent access controls, device limits, or subscription restrictions.
  • Use bots or scripts in unauthorized ways.
  • Impersonate any person or entity.
  • Upload or transmit malware or malicious code.
  • Engage in academic dishonesty, including plagiarism or sharing assessment content.

PeakLearn may remove content and suspend or terminate accounts that violate this policy at our sole discretion, with or without prior notice, subject to the provisions of Section 11.

Section 09

Privacy & Data

Our data practices are governed by our Privacy Policy, incorporated into these Terms by reference. Key points:

  • Data collected: Name, email, phone, date of birth (Students), academic records, payment records, device session data, and access logs.
  • Purpose: Delivering the service, processing payments, fraud prevention, and platform improvement.
  • Tenant isolation: Your data is stored in a tenant-specific database and is not shared with other tenants.
  • Payment data: Card details are handled entirely by Paymob. We retain only transaction records for accounting purposes.
  • Access logs: All requests are logged (IP, URL, user agent, identity) for security and audit purposes.
  • Third-party sharing: We do not sell your data. It is shared only with Paymob and as required by law.
  • Your rights: You may request access, correction, deletion, or portability of your data. Contact Peaklearns@gmail.com.
Section 10

Disclaimers & Limitation of Liability Updated (9-5-2026)

No Warranty

The Platform is provided on an "as is" and "as available" basis without warranties of any kind, express or implied, including merchantability or fitness for a particular purpose. We do not warrant uninterrupted or error-free operation.

Educational Disclaimer

Course content is provided for educational purposes only. PeakLearn does not guarantee employment outcomes, professional certifications, or specific academic results. All such claims, if any, are made solely by the relevant Instructor or tenant institution and are their exclusive responsibility. PeakLearn is not liable for any reliance placed on such claims.

Limitation of Liability

To the fullest extent permitted by applicable law, PeakLearn and its officers, employees, and agents shall not be liable for any indirect, incidental, special, punitive, or consequential damages, or loss of profits, data, goodwill, or business opportunity, arising out of or in connection with your use of, or inability to use, the Platform, including but not limited to:

  • Unauthorized access to or alteration of your data;
  • Payment processing errors or delays;
  • Any interruption, suspension, or termination of the service;
  • Any loss resulting from course content, teaching methods, or learning outcomes.

To the fullest extent permitted by applicable law, our total aggregate liability arising out of or relating to the Platform, these Terms, or any use thereof — whether in contract, tort (including negligence), or otherwise — shall not exceed the total amount you paid to PeakLearn in the twelve (12) months immediately preceding the event giving rise to the claim.

Mandatory Legal Rights: Nothing in these Terms shall operate to exclude or limit any liability that cannot be excluded or limited under applicable law, including any mandatory consumer protection rights afforded to you under the laws of the Arab Republic of Egypt.
Section 11

Termination Updated (9-5-2026)

By You

You may terminate your account at any time by contacting Peaklearns@gmail.com. Termination does not automatically entitle you to a refund for unused enrollment periods. Our Refund Policy in Section 06 and applicable statutory rights will govern any such requests.

By PeakLearn

We may suspend or terminate your access to the Platform, in whole or in part, at our sole discretion, where we reasonably believe that:

  • You have violated these Terms or any applicable law or regulation;
  • There is suspected fraud, chargeback abuse, or other illegal or abusive activity;
  • You are attempting to circumvent access controls, device limits, or subscription restrictions; or
  • Such suspension or termination is required to comply with any court order, regulatory requirement, or applicable law.

Effect of Termination

Access ceases immediately upon termination. Data may be retained for legal and compliance purposes per our Privacy Policy. Outstanding payment obligations remain enforceable. Provisions that by their nature survive termination — including intellectual property, limitation of liability, and governing law — shall remain in full force and effect.

Section 12

Force Majeure Updated (9-5-2026)

We shall not be liable for any delay or failure to perform any of our obligations under these Terms if and to the extent such delay or failure results from events, circumstances, or causes beyond our reasonable control, including but not limited to natural disasters, war, riots, civil commotion, strikes, lock-outs, governmental actions, epidemics, pandemics, failures of telecommunications or internet service providers, or power outages ("Force Majeure Events").

Our obligations under these Terms shall be suspended for the duration of the Force Majeure Event and shall resume as soon as reasonably practicable after the Force Majeure Event has ceased. We will use reasonable efforts to notify users of any significant disruption caused by a Force Majeure Event and to minimise its impact on the Platform.

Section 13

Copyright Complaints & Takedown Requests Updated (9-5-2026)

PeakLearn respects intellectual property rights. If you believe that any content available on the Platform infringes your intellectual property rights, you may submit a written notice to:

Your notice must include at a minimum:

  • Your full name and contact details;
  • A description of the content you claim is infringing and where it is located on the Platform (URL or course name);
  • Evidence or a statement of your ownership of, or authorization to act on behalf of, the rights holder;
  • A clear statement that you have a good-faith belief that the disputed use is not authorized by the rights holder, its agent, or the law.

We may, at our sole discretion and without obligation to you, temporarily disable access to or permanently remove the allegedly infringing content while we review the notice. We may also take appropriate action against the relevant Instructor or user in accordance with these Terms and applicable law.

Submitting a false or bad-faith takedown notice may expose you to liability under applicable law.

Section 14

General Provisions Updated (9-5-2026)

Entire Agreement

These Terms, together with our Privacy Policy and any policies or documents expressly incorporated by reference, constitute the entire agreement between you and PeakLearn regarding your use of the Platform. They supersede all prior or contemporaneous understandings, agreements, representations, or communications, whether written or oral, relating to the subject matter hereof.

Severability

If any provision of these Terms is held by a court of competent jurisdiction to be invalid, illegal, or unenforceable, that provision shall be enforced to the maximum extent permissible so as to give effect to the intent of the parties, and the remaining provisions shall remain in full force and effect without interruption.

No Waiver

Failure by PeakLearn to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision unless acknowledged and agreed to in writing.

Language

These Terms may be made available in more than one language for convenience. In the event of any discrepancy or conflict between the Arabic version and any translated version, the Arabic version shall prevail for interpretation and enforcement purposes.

Section 15

Governing Law

These Terms are governed by and construed in accordance with the laws of the Arab Republic of Egypt, without regard to conflict-of-law provisions.

Disputes arising out of or relating to these Terms or the Platform shall first be attempted to be resolved through good-faith negotiation between the parties. If a dispute remains unresolved for more than thirty (30) days from the date of first written notice, it shall be subject to the exclusive jurisdiction of the competent courts of the Arab Republic of Egypt.
